1. Information We Collect
We collect information in the following categories:
1.1 Information you provide directly
- Contact & business information: When you fill out our contact form, request a consultation, or email us, we collect your full name, company name, work email, phone number (if provided), team size, roles of interest, and the content of your message.
- Communications: Records of correspondence when you contact us via email, phone, or social channels.
- Talent & candidate information: If you apply for a role managed by Nearlume, we may collect CV/résumé, employment history, and interview notes — governed by a separate candidate notice.
1.2 Information collected automatically
- Usage & device data: IP address, browser type, operating system, referring URLs, pages viewed, time spent, and clickstream data.
- Cookies & similar technologies: See Section 3.
1.3 Information from third parties
We may receive business contact information from partners, referral sources, or public professional networks (e.g., LinkedIn) where permitted by law.
2. How We Use Your Information
We use personal information to:
- Respond to inquiries, provide quotes, schedule consultations, and deliver our nearshore staffing and operations services.
- Personalize and improve the Site, analyze usage trends, and diagnose technical issues.
- Send administrative updates, service announcements, and — where you have consented — marketing communications about Nearlume services. You may opt out at any time.
- Comply with legal obligations, enforce our Terms, and protect the rights, safety, and property of Nearlume, our clients, and talent.
- For other purposes with your consent or as otherwise disclosed at the time of collection.
Legal bases (EEA/UK users): Where GDPR applies, we process data on the basis of contract performance, legitimate interests (e.g., improving our services and B2B outreach), legal compliance, and consent where required.
5. Data Retention
We retain personal information only as long as necessary to fulfill the purposes described above, including to satisfy legal, accounting, or reporting obligations. Contact-form inquiries are typically retained for up to 24 months unless a business relationship is established, in which case retention follows our client-record schedule. Criteria for determining retention include the nature of the data, risk of harm, and applicable statutes of limitation.
6. International Data Transfers
Nearlume operates from Guatemala City, Guatemala, and serves clients primarily in the United States. If you access the Site from outside Guatemala, your information may be transferred to, stored, and processed in Guatemala and the United States or other countries where our service providers operate. We take appropriate safeguards to protect your information and, where required, rely on approved transfer mechanisms.

Depending on your jurisdiction, you may have rights including:
- Access, correction, and deletion of your personal information.
- Objection or restriction of certain processing.
- Data portability and the right to withdraw consent where processing is based on consent.
- Opt-out of marketing — use the unsubscribe link in emails or contact us at hello@nearlume.com.
- California (CCPA/CPRA): Right to know, delete, correct, and opt out of sale/sharing (we do not sell personal information). You may also limit use of sensitive personal information where applicable and not be discriminated against for exercising your rights.
- EEA/UK (GDPR): Right to lodge a complaint with your supervisory authority.
To exercise your rights, email hello@nearlume.com with the subject line "Privacy Request." We may need to verify your identity before responding. We will respond within the timeframe required by applicable law.
